Public Adjuster Cost & Fees in Florida: The Statutory Caps
A Florida public adjuster costs no more than 20% of the claim payment (10% in a declared catastrophe’s first year), with no upfront fee. Here is how it works.
In Florida, a public adjuster’s cost is capped by law and paid only from what they recover. Fla. Stat. 626.854(11) limits the fee to 20% of the claim payment the insurer makes, and to 10% for claims arising in the first year of a declared state of emergency. There is no upfront fee: the fee is contingent, calculated on the settlement, and only owed if the public adjuster secures a payment.

What is the fee calculated on?
The cap applies to the claim payment the insurer makes on the loss the public adjuster is handling. It is not an hourly charge and not an upfront retainer. Reputable Florida public adjusters put the capped percentage in a written contract before any work begins, as required by the licensing rules under Fla. Stat. 626.854.
