Florida Statute 626.913(4) says that except where a section specifically states it applies to surplus lines insurers, the provisions of Chapter 627 do not apply to surplus lines insurance. Chapter 627 is where nearly every protection people think they have lives. The 7-day acknowledgment. The 60-day pay-or-deny with interest running from notice. The Homeowner Claims Bill of Rights. The free state mediation program. The rule limiting how a carrier can object to your umpire. On a surplus lines policy, presume all of that is off the table until you find language saying otherwise.
Here is the part that makes people angry, and they should be. The deadlines that bind the policyholder still reach surplus lines. Florida Statute 627.70132 says so on its face, applying the one-year notice bar to property policies including those issued by an eligible surplus lines insurer. So does the presuit notice requirement in 627.70152. You keep your obligations and lose most of the carrier's. That asymmetry is the whole file.
On the authority question. A coverholder writes and administers under a binding authority agreement with one or more syndicates, and their claims-handling authority is capped at a dollar figure. Above that number the decision goes to the leader. So the question to put in writing is not "who is my adjuster," it is: identify the lead syndicate, the contract reference, the claims-handling authority limit under the binding authority, and the name of the person with authority at the level this claim now sits.
Ask that in writing and the rotation usually stops, because somebody has to answer it.
Florida Statute 626.924(2) requires surplus lines policies issued on or after October 1, 2009 to carry on the face of the policy, in at least 14-point boldface, a statement that surplus lines insurers' policy rates and forms are not approved by any Florida regulatory agency. That sentence is the answer to your question. Admitted carriers file their forms with the Office of Insurance Regulation and get them approved. Surplus lines carriers write manuscript forms. That flexibility is the point of the market, it is how you got a policy at all, and the cost is that your form is one of a kind.
And the one nobody mentions: the Florida Insurance Guaranty Association does not stand behind surplus lines. If the carrier fails, there is no state fund.
